This Site is owned and operated by Primness Pty Ltd (ABN 56 113 453 455) (“Primness”).  Primness reserves the right to alter, modify, add to, or change in any way, any provision of these Terms & Conditions and may, in its absolute discretion, limit or expand the services available via the Site without giving prior notice to the Users.

All materials on the Site including, but not limited to, underlying software, code, design, text, graphics, video, and other files (“Content”) is the sole property of Primness or is licensed to Primness. All rights are reserved. No Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the prior written consent of Primness.

All Trade Marks (registered and unregistered), logos, trade dress and service marks on the Site are either Trade Marks or registered Trade Marks of Primness and may not be copied, imitated, or used, in whole or in part, without the prior written consent of Primness.

You are licensed to use the Site on your computer for your use in purchasing goods from Primness. You acknowledge that you are not permitted to make any other use of the Site other than for personal use.

We accept payment via Mastercard, Visa card, Paypal & Afterpay for online purchases. Once your order has been approved you will receive immediate order confirmation via email. We attempt to provide accurate imagery and descriptions of all our products, however colours may vary slightly depending on computer monitor resolutions.

At Primness all garments are designed and made with love. To ensure longevity and to preserve the quality of your Primness products please follow the care instructions communicated on each garment carefully. Primness is not liable for any damage caused due to improper care.

The price you pay for goods is the price specified on the website. In doing so you agree to pay the delivery and handling fee including goods and services tax (Australia Only) which Primness is required to collect from you.

Primness prices are subject to variation without notice. The price payable for the goods shall be the price applicable on the date the goods are confirmed as ordered. You shall pay for the goods at the time you order. 

To the extent permitted by law, you agree that any liability of Primness arising out of or in connection with any breach of any express or implied warranty or condition in respect of goods or services supplied to You through use of Primness will be limited to:

(a) if the condition relates to goods, the replacement of the goods or the supply of equivalent goods; and

(b) if the condition relates to services, the supplying of the services again or the payment of the cost of having the services supplied again.

To the extent permitted by law, You release and discharge Primness and its related corporations, Directors, officers, employee and contractors from all forms of direct, special, indirect or consequential loss or damage (including loss of profits, loss of data or loss or damage that may reasonably have been supposed to have been in the contemplation of the parties as at the date of this Agreement) arising out of or in connection with Primness or this Agreement, including, without limitation, loss or damage caused by the negligence of Primness or its related corporations.

If you are issued with a password by Primness, You agree to take responsibility for the safekeeping of your password. You are liable if an unauthorised person uses your password. You agree to release and forever indemnify Primness in relation to any liability arising out of the unauthorised use of your password.

Primness may add to, delete, or otherwise change any of the terms of this Agreement. Your use of the Site will constitute your deemed acceptance of such changes.

Primness is subject to the National Privacy Principles in the Privacy Act 1988 (Cth). This Privacy Policy explains in general terms how Primness protects the privacy of your personal information under the National Privacy Principles. It also sets out the matters, which we are required to disclose to individuals under National Privacy Principles 1.3 and 1.5. The principles set out in this Primness Privacy Policy will apply to any personal information you provide to Primness via our web site or under any agreement or arrangement and to information, which we collect about you from other sources.

For example, we may collect personal information about you when you deal with us over the telephone, send us correspondence (letter, fax or e-mail) join the Primness mailing list or when you have contact with us in person i.e., at a clearance sale. Primness collects personal information for the following purposes:
To provide you with information about Primness products via e-mail;

  • To sell you Primness products over the internet;
  • To enable Primness to undertake Credit assessment i.e. Stockists;
  • To consider making offers of employment or for employment purposes;
  • To receive services from you or the organisation which employs you; and
  • To disclose information to a manager of your superannuation funds.

In some circumstances, we collect personal information about you from a third party source. If we collect personal information about you in this way, we will take reasonable steps to contact you and ensure that you are aware of the purposes for which we are collecting your personal information and the organisations to which we might disclose your personal information.

We will use and disclose personal information for the primary purpose for which it was collected. We may also use and disclose personal information for purposes related or ancillary to the main reasons we collect it, such as invoicing, reminder notices, provision of information concerning Primness and other services offered by us. For example, we may engage third party contractors to maintain and monitor our customer and user databases. We will, on request, provide you with access to the personal information we hold about you unless there is an exception, which applies under the Privacy Act such as employee records. Your request to obtain access will be dealt with in a reasonable time. Primness may recover from you its reasonable cost of providing you with access. If we refuse to provide you with access to the information, we will provide you with reasons for the refusal and inform you of any exceptions relied upon under the Privacy Act.

We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date whenever we collect or use it. If any of the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will take reasonable steps to correct this information or, if necessary, we will discuss alternative action with you.

Unauthorised access, modification and disclosure. Your personal information may be stored either in hard copy documents or as electronic data in Primness’s software or systems. We maintain physical security over our paper and electronic data stores and premises, such as locks and security systems. We also maintain computer and network security; for example, we use firewalls (security measures for the Internet) and other security systems such as user identifiers and passwords to control access to our computer system.
